Plant Performance Guarantee

Aspen Landscape agrees to replace, one time only, any tree, shrub, or evergreen that fails to survive within one (1) year from the date of installation. This guarantee is subject to the following conditions:

  • All plants must receive proper care from the property owner.
  • The project account must be paid in full according to the terms of the original contract.
  • The guarantee does not cover plant material damaged by mechanical injury, includingvandalism, animals, vehicle damage, or weather-related injury such as winter snowdamage or sunburn.
  • At no time is Aspen responsible for damages greater than the original purchase price paid for the plant material.

Annuals, seasonal color, and plants relocated or modified by parties other than Aspen
Landscape are not covered under this guarantee.


Hardscape Workmanship Warranty

All hardscape materials are covered under the original manufacturer’s warranty. Aspen
Landscape’s workmanship on hardscape installations including retaining walls, patios,
stone steps, and structural stonework is guaranteed for twenty-four (24) months from the date of installation.

This workmanship warranty does not cover discoloration of concrete-based materials, which is a natural product characteristic outside the scope of installation quality.


Brick Paving Warranty

All brick paving materials and workmanship are guaranteed for twenty-four (24) months from the date of installation. This warranty excludes the natural discoloration and efflorescence of concrete-based paver products, which are inherent product characteristics.


Sod and Seeding

Aspen Landscape uses the highest-quality seed and sod available, capable of producing ahealthy, satisfactory lawn under normal conditions. Because Aspen cannot controlsubsequent weather conditions or post-installation customer care, performance of seed andsod beyond the day of installation is the responsibility of the property owner.


Acts of God

In the event of product failure or destruction of completed work due to Acts of God (severe storms, flooding, lightning, or other natural events beyond reasonable control), Aspen Landscape will replace or repair the affected work with materials of equal value. The cost of such replacement or repair will be borne equally between Aspen Landscape and the property owner a fair and reasonable compromise for conditions outside the control of either party.


Drain Tile and Drainage Systems

Where required and included in the project scope, drain tile is designed and installed to helpreduce standing water and assist in landscape drainage. Drain tile performs within specifieddesign capabilities; Aspen Landscape is not responsible for damages resulting from drainageconditions that exceed the design specifications of the installed system.


Property Protection

Aspen Landscape takes responsibility to protect property and perform work in a timely, professional manner. However, Aspen is not responsible for damage to roads, driveways, or staging areas when access and use of these areas is granted by the property owner for project equipment and material staging.

The property owner is responsible for locating and marking all privately installed utilities prior to the start of work, including but not limited to: irrigation lines, electrical or gas lines, outdoor lighting, sewage, and silent fencing. Repairs or relocations of irrigation lines discovered during the project will be billed as additional work.


Warranty Transferability

Warranties provided by Aspen Landscape are non-transferable. Coverage applies to theoriginal property owner at the address where the work was performed. If the propertychanges ownership during the warranty period, the warranty terminates at the time ofproperty transfer.
